Terms of Usage
The rules for using this site and buying from us — please read them before you start.
Last updated: 4 September 2026
Who we are
This site is operated by Burlington Scott (Scotland) Limited, a company registered in Scotland under company number SC233333, trading as Discount Warehouse Club. Our warehouse and showroom is at 9/11 Palacecraig St, Whifflet St, Coatbridge ML5 4RY. In these terms, "we", "us", and "our" mean Burlington Scott (Scotland) Limited, and "you" means the person using the site, creating an account, or placing an order — whether that's for themselves or, in the ordinary course of shopping, on behalf of a household member or as a gift for someone else.
Acceptance of these terms
By using this website, browsing our products, creating an account, or placing an order, you agree to these terms in full.
Who can buy from us
You must be at least 18 years old and legally able to enter into a binding contract to place an order or join the Club. By placing an order, you're confirming that this is true of you. If we become aware that an order was placed by someone under 18 we may cancel the order and refund it, and may take reasonable steps to prevent further orders from that account.
None of our current product categories, including workwear and safety footwear, carry any age restriction beyond this general 18+ requirement to hold an account and place an order.
Using the site
You're welcome to browse, search, and shop here for your own personal use, or on behalf of your household. You agree not to:
- Use the site for any unlawful purpose, or in a way that could damage, disable, overburden, or impair it — for example, automated bulk requests that place unusual load on the site
- Attempt to gain unauthorised access to any part of the site, other customers' accounts, or our internal systems
- Scrape, copy, republish, or systematically extract site content — including product listings, images, and pricing — without our permission, whether by automated tools or manually
- Submit false, misleading, or fraudulent information when placing an order or creating an account — including, for example, a false name or address intended to disguise a returning customer we've previously had reason to restrict
- Misuse or attempt to circumvent Club or Student pricing — for example, falsely claiming student status using an email address that isn't genuinely a valid university address, sharing a single verified student's access with people who aren't themselves eligible, or attempting to combine discounts in a way these terms don't allow
- Buy for resale purposes, or in quantities suggesting commercial rather than personal use, without our prior agreement — for example, repeatedly purchasing the maximum available stock of a specific item shortly after it's listed
If we reasonably believe any of the above has happened, we may suspend or close the account involved, decline or cancel related orders, and reserve the right to take further necessary action including recovering any loss caused as a result.. We will always try to raise our concerns with you direct in the first instance.
Your account
If you create an account, you are responsible for keeping your login details secure and for anything that happens under your account, including orders placed and any Club or Student pricing applied, whether or not you personally carried out the specific action. Let us know straight away if you think someone else has gained access to it without your permission, and we'll help secure it.
Club membership and student verification are personal to the account holder and are not transferable to another person or account, even within the same household. If you close an account and later create a new one, any remaining Club membership period or student verification doesn't automatically carry over — each is tied to the specific account it was granted on.
Orders, pricing & availability
We try to keep prices, descriptions, and stock levels accurate, but mistakes can happen, particularly given how much of our stock turns over as warehouse and clearance lines. If we find a genuine error in the price or description of something you've ordered — for example, a price displayed significantly below what was intended due to a data entry mistake — we'll contact you before proceeding with that order, and you'll have the choice to continue at the correct price or cancel that part of your order for a full refund of what you paid for it. We won't simply charge you more without asking first.
Placing and paying for an order doesn't guarantee the item is actually available — our stock levels update as orders come in, but with items that exist in very limited quantity (a single unit of a specific size, for example), it's possible for two people to order the last one before our systems catch up. If that happens, we'll let you know as soon as we identify it and refund you in full for anything we genuinely can't fulfil, rather than substituting a different item without asking.
Some products may show up to three prices: an approximate comparison price shown for context only, our standard price (available to everyone, with or without an account), and a lower Club price (available once you're a paying Club member and signed in). Selected products may also carry a separate Student price, available to customers with a verified university email address, independent of Club membership. Where more than one of these could genuinely apply to the same product for the same customer, you'll always be shown whichever is lower — Club and Student pricing don't add together under any circumstance, even where it might seem like a reasonable customer expectation that they would. Promotional discount codes apply to our standard price only, and don't apply on top of an already-reduced Club or Student price on the same item.
Many of the items we sell are warehouse, clearance, or liquidation stock, which is part of how we're able to offer the prices we do. Where relevant, we'll describe an item's condition as accurately as we reasonably can — but given this kind of stock can include single units, discontinued lines, or end-of-run colours, exact shade, packaging, or very minor cosmetic variation may differ slightly from the photographs shown, and this isn't treated as the item being "not as described" in a way that would entitle you to a return on that basis alone, provided the core product itself matches what was listed.
All stock we sell is unsold, new stock bought in as warehouse, clearance, or liquidation lots — none of it is used, customer-returned, or graded condition. Where an individual item is genuinely not new (for example, an ex-display or refurbished unit), we'll say so clearly on that specific product listing rather than relying on this general clause to cover it.
When a contract is actually formed
Placing an order and paying for it is an offer by you to buy, not an automatic acceptance by us. You'll receive an order confirmation email once payment has gone through, but that confirmation is acknowledgement that we've received your order, not yet a binding contract to supply it — the contract between us is only formed when we confirm your order has been dispatched. Between those two points, we can decline or cancel an order — for example, if an item becomes out of stock, there's a pricing error of the kind described above, we suspect fraudulent activity on the account, or we're unable to verify a payment. If that happens, we'll tell you and refund anything already paid for that order in full and promptly.
If your order contains several items and only some of them are ready to dispatch at the same time, we may either hold the whole order until everything is ready, or split it into more than one delivery at no extra delivery cost to you — we'll let you know if we do this, since it affects when tracking information and each part of the order will arrive.
Your legal right to cancel an order
As a consumer buying online, you have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel most orders within 14 days of receiving them, for any reason, without needing to give one. This right is separate from, and in addition to, our own 28-day returns policy described on our Delivery & Returns page — the two overlap for the first 14 days, after which only our own store policy continues to apply for the remaining period up to 28 days.
To cancel under this legal right, you need to tell us clearly that you're cancelling within the 14-day window — simply sending the item back without any communication may be treated as a return under our ordinary returns policy instead, which could affect the postage-fee calculation described there. Once you've told us you're cancelling, you then have a further 14 days to actually send the item back. We'll refund you, including the original standard delivery cost you paid (though not any faster/premium delivery option you chose over our standard one, if such an option exists), within 14 days of receiving the item back or receiving evidence that you've sent it, whichever is earlier.
This legal cancellation right doesn't apply to Club membership once you've chosen to start using it immediately — see the Club Membership section below for how the equivalent 14-day right works for a paid membership rather than a physical product.
None of our current product categories fall within the specific exceptions to this cancellation right set out in the Consumer Contracts Regulations 2013 — for example, we don't sell sealed goods that become unsuitable for return once unsealed for hygiene reasons. The 14-day right described above therefore applies across our full catalogue.
Club membership
Club membership costs £5 for 12 months from the date it starts, charged once at sign-up rather than automatically renewing. We'll email you a reminder before your membership is due to lapse, giving you the choice to renew; if you don't renew, your account simply reverts to standard pricing at the point it lapses, with no further payment taken from you without your active say-so.
As a consumer, you normally have 14 days to cancel a paid service like this for a full refund, in the same way you would for a physical product. Because the whole point of Club membership is to unlock a lower price immediately, we ask at the point of joining whether you'd like to start using Club pricing straight away — choosing to do so means you're specifically asking us to begin the service immediately, and in doing so you agree that you lose this 14-day cancellation right once you've started benefiting from it, in line with the law's treatment of services you've asked to start right away. If you'd prefer to keep the full 14-day cancellation right instead, contact us before making any purchase at the Club price and we can hold off activating your membership pricing until that window has passed.
If your membership lapses partway through an order you're actively completing — for example, your membership expires on the same day you're checking out — the price applied is whatever your membership status genuinely was at the moment you completed payment, not an earlier or later point in that same session.
We may change what Club membership includes in the future — for example, adjusting the free-delivery threshold, or adding further benefits — but any changes of this kind will only apply to memberships taken out or renewed after the change, not partway through a 12-month period you've already paid for under the terms that applied when you joined.
Student discount
Student pricing is available on selected products only, to anyone with an account who verifies a valid university (.ac.uk) email address. It doesn't require Club membership. As explained above, Club and Student pricing don't stack — if a product qualifies for both, you're automatically charged whichever of the two is lower, never both together, so having Club membership can determine which of the two prices you actually pay without ever adding to it. Verification lasts 12 months from the date it's confirmed, after which you'll need to re-verify using a valid university email address again — if you've since graduated and no longer have access to one, the discount will simply lapse at that point.
We reserve the right to ask for further evidence of student status beyond the university email address alone, and to remove the discount from an account, without notice where practical, if we reasonably believe it's being misused — for example, an account that's clearly not being used by the verified individual personally.
Delivery & returns
Full details of our delivery charges, the £30 free-delivery threshold for Club members, our weight-based handling charge, and our 28-day returns policy — including faulty items, exchanges, and how a return's postage fee is calculated — are set out in full on our Delivery & Returns page, which forms part of these terms just as much as the sections above.
Risk in a product — meaning who bears responsibility if it's lost or damaged — passes to you once it's been delivered to the address you provided, not before. Ownership of the product passes to you once we've received payment for it in full, which for a standard order is at the point of checkout.
Protection of your Consumer Rights
Nothing in these terms, or in our own returns and delivery policies, removes or reduces your statutory rights as a consumer under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013. If an item is faulty, not as described, or not of satisfactory quality, or if you're entitled to cancel under the legal cancellation right described above, those rights apply in full regardless of anything else stated elsewhere on this site, and take precedence over our own policies wherever the two would otherwise conflict.
Intellectual property
The site's design, text, graphics, logos, and the underlying code belong to us or our licensors and are protected by copyright, trademark, and related laws. You may browse and use the site for your own shopping, but may not copy, reproduce, republish, or exploit any of it commercially without our written permission.
No warranty on the website itself
We aim to keep this site accurate, secure, and available at all times, but we can't guarantee it will always be error-free, uninterrupted, or entirely free of viruses or other harmful components, and we're not responsible for any loss or damage caused by your use of a device or network we don't control. You use the site at your own risk in this respect, though this doesn't affect the statutory rights and protections described elsewhere on this page in relation to products actually purchased.
Limitation of liability
To the fullest extent permitted by law, we won't be liable for any indirect or consequential loss arising from your use of this site or a purchase made through it — for example, loss of income, business, or opportunity that isn't a direct and foreseeable result of our wrong doing. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can't legally be limited or excluded under UK law. This section doesn't affect your statutory rights as a consumer, which remain fully protected regardless of anything stated here.
Events beyond our control
We won't be responsible for any delay or failure to meet our obligations under these terms where that's caused by something reasonably beyond our control — for example, severe weather affecting courier networks, industrial action, a supplier failing to deliver stock to us, or a significant IT or telecommunications failure affecting the site or our payment processor. If something like this happens, we'll let you know as soon as reasonably possible, and take reasonable steps to reduce the impact on your order, including offering a refund if a significant delay becomes unreasonable.
If part of these terms is found invalid
If any individual part of these terms is found by a court or regulator to be unenforceable or invalid, that finding won't affect the validity of the rest of these terms, which will continue to apply in full as if the unenforceable part had been removed.
Complaints
If something's gone wrong please contact us directly first using the details below. We'd always rather have the chance to sort things out with you directly, and in our experience most issues can be resolved this way without needing to go further. If we're genuinely unable to resolve things between us after making a reasonable attempt to do so, you may be entitled to refer the matter to Retail ADR, an alternative dispute resolution provider approved by the Chartered Trading Standards Institute, at retailadr.org.uk.
Changes to these terms
We may update these terms from time to time, for example to reflect a change in the law, a new feature on the site, or a change to how Club membership or student pricing works. The date at the top of this page shows when they were last revised. Continuing to use the site after a change has been published means you accept the updated terms for anything you do afterwards — but for an order you'd already placed before the change, the terms that applied at the time you placed that specific order will continue to govern it, not the updated version.
Third-party rights
These terms create a contract between you and us alone. No one else has any right to enforce any part of these terms directly against us, even where they end up using or receiving something bought under them.
Governing law
These terms, and any dispute or claim arising from them or from an order placed through this site, are governed by the laws of Scotland, and the Scottish courts will have jurisdiction over any such dispute. If you're a consumer living elsewhere in the UK, mandatory consumer protection law in your own part of the UK may still also apply to you, and you may be entitled to bring proceedings in your local courts instead, depending on the circumstances.
